A Florida man charged with pepper spraying Capitol Police on January 6, 2021, seeks to revoke his order of pretrial detention. Man: I have non-Hodgkin's lymphoma and at increased risk of contracting COVID-19. D.C. Circuit per curiam: Well, we can't say you're wrong but now that you've tested positive for COVID-19, you're no longer at increased risk of contracting it. Appeal denied. Ask the district court if the diagnosis itself and necessary treatment merits pretrial release.
