A woman from El Salvador, who entered the U.S. illegally, is entitled to a new bond hearing where the government must prove by a preponderance of the evidence that she isn’t a flight risk while awaiting her removal proceedings, the First Circuit said (article available here).

The court held that putting the burden on Ana Hernandez-Lara to show she wouldn’t flee if released on bond violated her due process rights.
