This case involves some very disturbing allegations concerning a federal prisoner’s sexual assault and battery at the hands of his captors.

Allegations in the lawsuit are that guards at federal prison in Atlanta restrained and stripped an inmate and fondle his genitals and buttocks. Eleventh Circuit: While this is behavior “we condemn [] in the strongest possible terms,” under the Federal Tort Claims Act, there is no remedy. The inmate suffered neither a “physical injury” nor any of the types of “sexual acts” enumerated by Congress.

The case is Andy R. Johnson v. Dexter White et. al., 19-14436 (11th Cir. Feb. 26, 2021).
