An armed person robs a Pittsburgh store precisely when the store safes was most likely to be full. The person also knew about a second safe that few others did. But there was no evidence that the man convicted of the crime in 2006 had inside knowledge of the store's operations, nor was he connected to the getaway car.
United States Court of Appeals for the Third Circuit: The fact that his fingerprint was on a manila envelope the robber left behindĀ do not add up to proof of guilt beyond a reasonable doubt. District court is reversed. Habeas granted with prejudice to re-prosecution.
