On June 26, 2015, the Supreme Court decided Obergefell v. Hodges, 576 U.S. 644 (5-4). The Court held that the Fourteenth Amendment requires states to license and recognize same-sex marriage.

The majority opinion by Justice Kennedy was joined by Justices Ginsburg, Breyer, Sotomayor, and Kagan, was issued on June 26, 2015.

The four dissenting Justices each wrote their separate opinions. Chief Justice Roberts filed a dissenting opinion, in which Justices Scalia and Thomas joined. Justice Scalia filed a dissenting opinion, in which Justice Thomas joined. Justice Thomas filed a dissenting opinion, in which Justice Scalia joined. Justice Alito filed a dissenting opinion, in which Justices Scalia and Thomas joined.

At the time of the decision, 36 states, the District of Columbia, and Guam had all already legalized same-sex marriage.
